Terms and Conditions of Sale
Last updated:
Welcome to Escargot Post 🐌 These terms and conditions of sale (the « Terms ») explain how buying on escargotpost.com works. Please read them before ordering.
1. The seller
Products sold on this website are sold by:
- Claire Servanton EI (sole trader, French « entrepreneur individuel »), trading name BlackCat CVSG, brand Escargot Post
- Address: 22 Chemin des Catalins, 26200 Montélimar, France
- SIRET (French business registration number): 824 742 167 00029
- Email: hello@escargotpost.com
- Phone: +33 6 11 27 10 19
- VAT not applicable, article 293 B of the French General Tax Code
In these Terms, « Escargot Post », « we », « us » and « our » mean the seller; « you » means the customer, an individual buying as a consumer.
2. Scope
These Terms apply to all orders placed on escargotpost.com and its English and Spanish versions. You accept them by confirming your order (« Order and pay » button, Apple Pay or Google Pay). The Terms that apply are those in force on the date of your order. They are written in French; their translations are provided for information, and the French version prevails.
3. The products
Escargot Post offers personalised letters for children, sent by post:
- the Discovery Letter: a single letter;
- subscriptions: one letter a month for the length chosen when ordering;
- the gift card: a card posted to the child, which lets them receive Escargot Post letters.
Each product is personalised with the child’s first name, last name and address that you give when ordering. Each letter is a unique creation: the pictures shown on the website are illustrations and may vary with production and paper.
4. Prices
Prices are in euros. VAT not applicable, article 293 B of the French General Tax Code. They include standard postage (untracked post), whatever the destination. The price that applies is the one shown when you order.
Tracked delivery is possible on request, before posting, for an extra cost that we will tell you (see the Shipping Policy).
5. Ordering
- Choose your product and enter the child’s first name, last name and address;
- check your basket, then enter your details;
- accept these Terms and pay;
- you receive a confirmation email: the order is then final.
You are responsible for the accuracy of the information you enter, especially the spelling of the child’s first name and their address: they are reproduced exactly as given on the letters. Creating a customer account is optional.
We may refuse or cancel an order for a legitimate reason (payment declined, incomplete address, unusual order). In that case, you are refunded in full.
6. Payment
Payment is made online, by card, Apple Pay or Google Pay, through our secure payment provider Stripe. The amount is charged when you order. Escargot Post never has access to your card details. A gift card or promotional code can be used at payment.
7. The gift card
The gift card is valid for 1 year from the date of purchase. It cannot be exchanged for cash or refunded, even in part.
8. Posting and delivery
Letters are prepared once a month. The first letter is posted within 5 weeks at most of your order being confirmed; for a subscription, the following ones are then posted every month. Letters are sent by La Poste (or its partners abroad), by standard untracked post, all over the world. Outside the European Union, the recipient may be asked to pay import duties or taxes.
Details are in the Shipping Policy.
9. No right of withdrawal
All our products are made to your specifications and clearly personalised (the child’s first name, last name and address). Under article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply. A confirmed order therefore cannot be cancelled or refunded, including subscriptions and the gift card.
10. Letter not received, damaged or wrong
- Letter not received: if nothing has arrived 6 weeks after your order (or after the planned posting date), write to us at hello@escargotpost.com with your order number. We will send the letter again free of charge.
- Damaged letter: write to us with a photo; we will send the letter again free of charge.
- Our mistake (misspelt first name, wrong content): we will send you a corrected letter.
- Mistake in the details entered when ordering (first name, last name or address): we will send one letter again free of charge, once per order or subscription.
Details are in the Refund Policy.
11. Legal guarantees
Our products are covered by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Translation, for information, of the official text required by French decree no. 2022-946 of 29 June 2022 (the French text in the French version of these Terms prevails):
The consumer has two years from delivery of the goods to have the legal guarantee of conformity applied if a lack of conformity appears. During this period, the consumer only has to prove that the lack of conformity exists, not when it appeared.
Where the contract of sale of the goods provides for digital content or a digital service to be supplied continuously for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to prove that the lack of conformity affecting the digital content or digital service exists, not when it appeared.
The legal guarantee of conformity obliges the seller, where applicable, to provide all updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and be refunded in full on returning the goods, if:
1° The seller refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after thirty days;
3° The repair or replacement of the goods causes the consumer major inconvenience, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The goods remain non-conforming despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to end the contract where the lack of conformity is so serious that an immediate price reduction or termination of the contract is justified. The consumer does not then have to ask for the goods to be repaired or replaced first.
The consumer is not entitled to end the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee until the goods are delivered back in working order.
The rights above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund on returning the goods.
12. Liability
We do everything we can to make sure each letter reaches its destination. We cannot be held responsible for a delay caused by postal services or by force majeure; a lost letter is sent again as set out in article 10.
13. Intellectual property
The website escargotpost.com (its design, layout and content) and Escargot Post’s texts, illustrations, logos and letters are protected by intellectual property law. They may not be reproduced without our written permission.
14. Your reviews
Your words, ideas and feedback inspire us 📝 By sending us a review or testimonial, you allow us to quote it (on the website or our social media) without changing its meaning. You can ask us to remove it at any time.
15. Personal data
The data needed for your order, including the child’s, is processed as explained in the Privacy Policy.
16. Customer service and mediation
For any question or complaint: hello@escargotpost.com.
If a dispute could not be settled with us in writing, you will be able to refer it free of charge to a consumer mediator, whose details will be given here very soon.
17. Governing law
These Terms are governed by French law. In the event of a dispute, and failing an amicable agreement, the competent court is determined by the legal rules; as a consumer, you may in particular bring proceedings before the court where you live.
